Online trademark applications

The United States Patent and Trademark Office (USPTO) has streamlined the ease of filing a trademark application by allowing for online preparation and filing of federal trademark applications. Applications can be filed online using this form. We recommend using a trademark attorney to prepare and file your application- they can help you avoid common pitfalls are errors when preparing your online trademark application.

Filing online through the USPTO reduces filing fees. The filing fee per class of goods/services for a paper application is $375. For regular online application (also known as TEAS), the filing fee per class is $325. If you file a TEAS Plus Application, the filing fee per class is $275. If your TEAS Plus application is not properly prepared, it is possible that the entire application will be rejected, thus we recommend filing a regular online application via TEAS (our office prepares and files all of our applications online via TEAS.)

Filing a trademark application online allows for you to immediately obtain a serial number upon online submission, and you will receive an electronic filing receipt almost immediately via email. Online trademark applications can be signed by multiple parties, which is easy if your signatories are located throughout the U.S. or the world.

Some states allow for filing trademarks online. The state of California does not provide for online trademark applications, however their applications are available in PDF format for printing and filing (see California Trademark Forms and Fees.)

To prepare and file a basic trademark application, including a consultation with a trademark attorney, our firm charges $400 (plus USPTO filing fee of $325). For each additional class of goods or services, our firm charges $100 (plus USPTO filing fee of $325 per class).

Our fee additionally includes reporting your filing, docketing reminders for your application, and reporting any correspondence received from the USPTO regarding your trademark application. The consultation before filing your trademark application will include a discussion about claiming the broadest scope of goods and/or services that you wish your mark to cover. We can additionally discuss what type of filing basis to use, and what type of trademark application to file.
